Acuerdo entre Irán y Argentina puede implicar impunidad sobre atentado terrorista

El Secretariado Permanente de la Red Latinoamericana y del Caribe para la Democracia (RedLad) alerta sobre la aprobación por parte del Congreso argentino de un acuerdo con el gobierno de Irán, con el fin de esclarecer el atentado de 1994 contra la AMIA (Asociación Mutual Israelita Argentina) en el cual murieron 85 personas y que fue el segundo atentado terrorista contra judíos en Argentina. Este tipo de atrocidades no prescriben y deben ser investigadas y los responsables llevados a la justicia. La impunidad genera las condiciones para que hechos como este puedan repetirse.
El acuerdo, busca permitir la interrogación pero solamente a los iraníes requeridos por la Justicia argentina. En concreto, estos iraníes buscados son Ahmad Vahidi, Ministro de Defensa de Irán, Alí Fallahijan, ex ministro de Información, Mohsen Rezai, ex asesor del gobierno iraní, Moshen Rabbani, es agregado de la embajada iraní en Buenos Aires y Ahmad Reza Ashgari, ex funcionario diplomático.
Los sospechosos, sobre los que pesan órdenes de captura por parte de la Interpol podrían ser enjuiciados bajo leyes argentinas pero sin tomar en cuenta la versión de los familiares de las víctimas o testigos. Luego de eso la "causa" quedaría saldada y la Interpol no podría intervenir. Otro elemento que ha generado controversia lo es que mediante el acuerdo, aprobado como Tratado Internacional por parte de Argentina, los acusados no deben prestar testimonios, además se esboza en el texto la existencia de "interrogatorios" pero no de indagatorias, las cuales son siempre necesarias en un proceso judicial.
Diputados de oposición, han argumentado que este acuerdo permitiría interrogar escuetamente a los implicados y luego dejarlos libres de la justicia argentina y de la Interpol. De hecho, se han realizado intensas manifestaciones ciudadanas en Buenos Aires, en contra de dicho acuerdo, no obstante, fue aprobada en el Congreso con el voto a favor por parte del oficialismo (ganando por tres votos) frente al voto negativo de todos los diputados de oposición.
Ante ello, el Secretariado Permanente de la RedLad, plataforma de impulso a la democracia y los derechos humanos integrada por más de 480 organizaciones, en su calidad de Miembro Oficial del Foro de Sociedad Civil de la Organización de Estados Americanos (OEA) y Capítulo Regional del World Movement for Democracy (WMD):
Hace un exhaustivo llamado al gobierno argentino para que desista del acuerdo con Irán, el cual tiende a nublar la realidad de los tristes acontecimientos sucedidos en 1994 y vuelva en impunidad la masacre y las violaciones de los derechos humanos.
Se solidariza con los diputados de oposición, especialmente con la diputada Laura Alonso, quien fue atacada verbalmente en el Congreso de la Nación Argentina cuando daba su punto de vista sobre el tema, por parte de un diputado oficialista.
Urge a la Presidenta Cristina Fernández para que solicite una justicia imparcial contra los implicados y su juzgamiento por parte de una entidad internacional competente que permita un proceso judicial acorde con los hechos.
Insta al gobierno argentino a permitir no sólo el interrogatorio de la parte acusada sino también el uso de testigos y familiares de las personas fallecidas como parte de un juicio justo.
Hace un llamado a la comunidad internacional, Organizaciones de la Sociedad Civil y ciudadanía en general para que exijan el enjuiciamiento transparente de los acusados y la implantación de penas acordes con los delitos cometidos en caso de encontrarse culpables.
Condena la impunidad en casos de graves violaciones a los derechos humanos y el "perdón" de sospechosos de terrorismo por razones de geopolítica ideológica.

Agreement between Iran and Argentina may imply impunity for a terrorist attack

The Permanent Secretariat of the Latin American and Caribbean Network for Democracy (RedLad) alerts on the approval by the Argentine Congress of an agreement with the government of Iran, in order to clarify the 1994 bombing of the AMIA (Asociación Mutual Israelita Argentina) which killed 85 people and that was the second terrorist attack against Jews in Argentina. Such atrocities are not prescribed and should be investigated and those responsible brought to justice. Impunity generates the conditions for events like this can be repeated.
The agreement seeks to allow the interrogatory but only to the Iranians wanted by Argentina Justice. Specifically, these Iranians sought are Ahmad Vahidi, Iran's defense minister, Ali Fallahijan, former Information Minister, Mohsen Rezai, former advisor of the Iranian government, Moshen Rabbani, ex worker in Iranian embassy in Buenos Aires and Ahmad Reza Ashgari, former diplomat.
The suspects, against whom there are arrest warrants by Interpol could be prosecuted under Argentine law but regardless of the version of the relatives of victims or witnesses. After that the "cause" would be solve, the Interpol could not intervene. Another element that has generated controversy is that by the agreement, approved as International Treaty by Argentina, the defendants must give their testimony and be part of an "interrogation" but not of inquiries, which are always required in judicial proceedings.
Opposition deputies have argued that the agreement would allow the interrogate those involved briefly and then release them of justice Argentina and Interpol. In fact, there have been intense demonstrations in Buenos Aires, contrary to the agreement, however, was approved by Argentine Congress with the vote by the ruling party (winning by three votes) compared to the negative vote of all deputies of opposition.
In response, the Permanent Secretariat of RedLad, platform promotion of democracy and human rights comprising more than 480 organizations, as an official member of the Civil Society Forum of the Organization of American States (OAS) and Regional Chapter of the World Movement for Democracy (WMD):
Makes an exhaustive called the Argentine government to desist in the agreement with Iran, which tends to cloud the reality of the sad events in 1994 and allow the impunity in human rights violations.
Shows it solidarity with the opposition legislators, especially to the Deputy Laura Alonso, who was verbally attacked in Congress of Argentina when she gave his view on the subject, by a government deputy.
Urges President Cristina Fernandez to seek impartial justice against those involved and their prosecution by an international body that allows a court in accordance with the facts.
Urges the Argentine government to allow not only questioning of the accused but also the use of witnesses and relatives of the deceased as part of a fair trial.
Calls upon the international community, civil society organizations and the general public to demand the prosecution of the accused and transparent implementation of appropriate penalties for crimes if them are found guilty.
Condemns impunity for serious human rights violations and the "forgiveness" of terrorist suspects by geopolitical and ideological reasons.
